Nicotine Pouch Laws in the US 2026: Federal Rules, State Flavor Bans and What Americans Buy
Nicotine pouches are legal for adults in the United States, but the rules are set at three levels: federal, state and sometimes city. Here is a plain-English overview of where things stand in late 2026, followed by what our US customers actually buy.
Not legal advice: this is a general overview. Laws change and local rules can be stricter. Check your state and city rules before you buy.
Federal rules
Minimum age: 21
Since the federal "Tobacco 21" law of December 2019, it is illegal to sell any tobacco product, including nicotine pouches, to anyone under 21 anywhere in the US.
Pouches are regulated as tobacco products
The FDA regulates nicotine pouches as tobacco products, whether the nicotine comes from tobacco leaf or is made synthetically. Synthetic nicotine was brought under the FDA's authority in April 2022.
FDA marketing authorization
To be legally marketed in the US, a new tobacco product needs a marketing order from the FDA, usually through a premarket tobacco product application (PMTA). Key milestones:
- January 2025: the FDA authorized 20 ZYN products, the first nicotine pouches to receive marketing orders.
- June 30, 2026: the FDA authorized those ZYN products to carry a modified-risk claim, stating that using ZYN instead of cigarettes puts a smoker at lower risk of mouth cancer and several other diseases. Read what the ZYN claim means.
- October 30, 2026: the FDA authorized 24 VELO products, all 4 mg mini pouches in flavors such as Crema, Lime, Orange Crema and Passion Fruit.
According to the FDA, 67 nicotine pouch products have now been authorized. Authorization is product by product: it applies to a specific flavor, strength and package, not to a whole brand. Many pouches on the US market, including many flavors made for Europe, have not received an FDA marketing order.
State rules
Flavor bans
| State | Rule | Since |
|---|---|---|
| California | Statewide ban on retail sale of flavored tobacco products, including menthol. Covers flavored nicotine pouches. | December 2022 |
| Massachusetts | Statewide ban on flavored tobacco and nicotine products, including menthol. | June 2020 |
| Many cities and counties | Local flavor restrictions, which can be stricter than state law. | Varies |
In states with a flavor ban, mint and menthol pouches are usually covered too, and only unflavored or "original" pouches can be sold. Check your city as well as your state.
Taxes
A growing number of states tax nicotine pouches as "other tobacco products", either per unit, by weight or as a percentage of the wholesale price. That is why the same can can cost very different amounts from state to state.
Online sales and delivery
Selling nicotine products online usually requires age verification, and some states also require remote sellers to be licensed or the delivery to be signed for by an adult aged 21 or over. Expect to be asked to verify your age when you order.
Quick checklist
- Are you 21 or over? Required everywhere in the US.
- Does your state or city ban flavored products?
- Does your state tax nicotine pouches?
- Will someone 21+ be there to receive the delivery?
What US customers buy most
Our US orders more than doubled between January and October 2026. US customers lean even more towards ZYN than the rest of the world: ZYN made up 56% of the cans we shipped to the US, and VELO about 16%.
The most-ordered pouches among US customers in 2026:
| # | Product | mg/pouch |
|---|---|---|
| 1 | ZYN Black Cherry Mini Extra Strong | 6 |
| 2 | ZYN Black Cherry Mini | 3 |
| 3 | ZYN Watermelon Mint Slim | 6 |
| 4 | ZYN Peach Mini | 3 |
| 5 | ZYN Apple Mint Mini | 3 |
| 6 | ZYN Spearmint Mini Low | 1.5 |
| 7 | VELO Freezing Peppermint MAX | 17 |
| 8 | ZYN Lemon Spritz Slim | 6.5 |
| 9 | ZYN Black Cherry Slim | 9 |
| 10 | ZYN Red Berry Fizz Slim | 11 |
Compared with other markets, US customers pick more fruit flavors (cherry, watermelon, peach, lemon) and lower strengths. Note that these are European flavors and are not the same products as the ZYN and VELO pouches the FDA has authorized for the US market.
